Felony court cases for Jan. 19 | The Mitchell Republic

The following cases were among those heard Tuesday during a circuit court session at the Davison County Public Safety Center, with Judge Chris Giles presiding:

  • Kelly Cruz, 39, of Bottineau, North Dakota, was sentenced to serve two years of probation and pay legal fees and fines in the amount of $890.70 for possession of a controlled substance (schedules I or II). Cruz was a passenger in a vehicle that authorities pulled over in March of 2020 and found 1.5 pounds of methamphetamine. The lone passenger with Cruz is facing most of the charges involved with the incident.
  • Brennan Linn, 22, of Roseville, Minnesota, was sentenced to serve one year of good behavior for speeding on other roadways.
  • Mauricio Longoria, 25, of Huron, pleaded guilty to a third-offense driving under the influence, which is a felony. Longoria will appear in court on March 30 for his sentencing hearing.
  • Steven Locke, 20, of King Prussia, Pennsylvania, was sentenced to serve two years of probation for possession of a controlled substance (schedules I or II). Locke was also ordered to pay legal fees and fines in the amount of $1,186.
  • Ashley Haus, 20, of Bridgeport, Pennsylvania, was sentenced to serve two years of probation for possession of a controlled substance (schedules I or II).
  • Brian Ruden, 39, of Mitchell, was sentenced to serve 14 days in jail and two years of probation for possession of a controlled substance (schedules I or II).
  • Connor Hoy, 21, of Mitchell, was granted a request to reappear in court on Feb. 2 for charges that include two counts of aggravated assault with a deadly weapon, two counts of aggravated assault against a law enforcement officer and aggravated eluding.
  • Tucker Melmer, 21, of Mitchell, pleaded guilty to a probation violation for a previous felony charge of possession of a controlled substance. Melmer will reappear in court on Feb. 16 for his sentencing hearing.
  • David Spirittrack Jr., 23, of Sioux Falls, pleaded guilty to fourth-degree rape involving a victim between the ages of 13 and 16. His sentencing hearing is scheduled for March 16. Spirittrack Jr. faces up to 15 years in prison and a $30,000 fine.
  • Syrus Givens, 39, of Mitchell, was sentenced to serve two years of probation for identity theft, a class 6 felony.
  • Vanessa Guevara, 28, of Mitchell, was sentenced to serve two years of probation and had her driver’s license suspended for one year. Her sentencing stemmed from her third offense driving under the influence charge.
  • Dakota Cranmer, 27, of Mitchell, was sentenced to serve four years of probation for violating his previous probation that was part of his sentence for possession of a controlled substance. Cranmer was accepted into a drug court program.
  • Victor Walker, 20, of Mitchell, was sentenced to serve four years of probation for violating his previous probation sentence for possession of a controlled substance and use or possession of drug paraphernalia.
  • Page Provancial, 34, of Mitchell, was sentenced to serve 15 days in jail and two years of probation for possession of a controlled substance (schedules I or II).
  • Franklin Vermillion, 43, of Mitchell, was sentenced to serve five years in prison wit credit for 14 days served in jail for failing to register as a sex offender, which he pleaded guilty to previously.
